1. Content

(1) These General Terms and Conditions of Use govern the relationship between LVLS (the Provider) and the user of the site (the User). These general terms and conditions constitute a contract between the parties, who have read and accepted them in their entirety by using the site.

(2) The version of the General Terms and Conditions of Use that applies to the User is the one in effect at the time the User visits the Provider's online portal. Only the currently applicable version will be visible on the said portal. It will remain accessible for consultation for the entire duration of its validity. Previous versions of the General Terms and Conditions of Use are not retained by the Provider. The Provider suggests that the User print a copy of these or save them to their computer.

2. Purpose

(1) The Provider's purpose is to offer an online portal where Users can rent electric golf carts offered by the Provider for short-term rentals. Use of the site is free for the User.

(2) The Provider allows Users to reserve a golf cart via the portal.

3. Golf Cart Rental

(1) On the Provider's online portal, the User can view the description, price, and photos of the golf carts.

(2) The User may request to reserve a golf cart, indicating arrival and departure dates. The User agrees to provide accurate information.

(3) The Provider reserves the right, at its sole discretion, to refuse any request from the User, without any compensation.

(4) Payment by the User constitutes acceptance of the regulations available on the website. Following payment, the Supplier undertakes to rent the golf cart for the dates specified in the quote, except in cases of force majeure.

(5) The reservation is non-refundable, except in cases of force majeure, such as hurricanes, earthquakes, etc. A €10 administration fee will be deducted.

(6) The Supplier may, at its sole discretion, grant the User's request to postpone a reservation to a later date. This postponement may not exceed one year.

4. Rights and Obligations of the Supplier

(1) The Supplier will make reasonable efforts to ensure that the information presented on the portal corresponds as accurately as possible to reality.

(2) The Provider shall not be held liable for any information that is not up to date or for any imperfect translation.

(3) The Provider will make reasonable efforts to keep the website technically up to date.

5. Website Ownership

(1) The Provider is the exclusive owner of the locationvoituretteslessaintes.com portal and its content. Reproduction of the website, in whole or in part, by copying text, graphics, or drawings is strictly prohibited.

6. User Information

(1) The User is required to enter and record accurate and precise information.

(2) Emails sent through the Provider's information request system must only contain genuine reservation requests. Misuse of the system is prohibited.

(3) The Provider complies with the provisions of the French Data Protection Act of January 6, 1978. For more information, please consult the Personal Data Management Policy.

7. Unauthorized Uses

No User or third party is authorized to:

(a) use the content of the locationvoituretteslessaintes.com website, including the database, by any automated or manual means. More specifically, it is prohibited to copy, distribute, reproduce, process, translate, decompile, or grant any right to use the data or otherwise use the content, or to make it available to the public, intentionally or unintentionally, partially or totally;

(b) use any automatic process or mechanism, such as indexing robots or others, to monitor the content of the site;

(c) use the site for purposes other than searching for and requesting cart rental.;

(d) transmit, send in any other way, or set up any content or program that, due to its size or nature, could

8. Tenant's Liability

The Tenant shall be solely and exclusively liable for all financial consequences resulting from damages suffered by the Provider due to content or programs transmitted or sent by the User that damage the Provider's system or its data, or cause the system to malfunction or fail. The aforementioned financial consequences shall include legal and expert fees.

9. Provider's Liability

Location Voiturettes Les Saintes shall not be liable for any damages arising from the relationship between the Owner and the User. Under no circumstances shall the Provider be liable for lost profits or any other direct, indirect, special, incidental, or punitive damages caused by the website or its use, even if the Provider has been advised of the possibility of such damages. If you do not agree with any provision of these terms and conditions, please do not use this website.

10. Communications with the Provider

(1) All communications from the Renter to the Provider must be sent to Location Voiturettes Les Saintes, 301 route du Marigot, 97137 Terre-De-Haut, Les Saintes.

11. Governing Law and Jurisdiction

(1) The relationship between the parties shall be governed exclusively by French law.

(2) The resolution of any dispute between the Provider and the User shall be subject to the exclusive jurisdiction of the French courts.

(3) The invalidity of one or more provisions of these terms and conditions shall not affect the validity of the other provisions.

(4) The Supplier recommends that each Tenant keep a copy of these terms and conditions on their hard drive or print it out for easy filing.

12. Right of Withdrawal

(1) The User is informed that, pursuant to Article L. 221-18 of the French Consumer Code, the Services offered on the Website by Location Voiturettes Les Saintes, either on its own behalf or on behalf of its Partners, are not subject to the right of withdrawal provided for in Articles L. 121-20 et seq. of the French Consumer Code concerning distance selling.

(2) Consequently, Services booked on the Website are exclusively subject to the cancellation and modification conditions set forth herein and/or in the applicable Partner Specific Terms and Conditions.

13. Mediator

(1) The contract between Location Voiturettes Les Saintes and the User is expressly governed by French law.

(2) Any dispute relating to its interpretation and/or performance shall be subject to the jurisdiction of the French courts.
